Pursuant to the Malaysian Personal Data Protection Act 2010 (“PDPA”), Herry Razak Realty is mindful and committed to the protection of your personal information and your privacy. This Privacy Notice explains how we collect and handle your personal information in accordance with the PDPA.

1. Collection of Personal Data

1.1 Type of Personal Data
Personal data means any information related to you and may include your name, identification card or passport number, contact details, financial and banking account details, age, gender, nationality, race, marital status, profession, and information in audio/video format (including voice or video recordings, CCTV, and photographs).

1.2 Source of Personal Data

• Customer or Potential Customer: Herry Razak Realty collects your personal information directly from you or indirectly from your legal representatives, agents, and/or employer when you, your legal representatives, agents, and/or employers send us completed enquiry, application, and/or registration forms via various means, including online and physical hard copies at public venues or in any of our premises. Your personal information may also be collected from cookies through the use of our website.
• Vendor, Supplier, Tenant or Service Provider: Herry Razak Realty collects your personal information directly from you or indirectly from your employer or credit reference agencies when tendering for projects, when you send us completed enquiry and/or credit application forms via various means, including online and physical hard copies. Your personal information may also be collected from cookies through the use of our website.

2. Purpose of Collecting Personal Data

We will process the personal data collected for the following purposes:

• In all matters relating to your purchase of the property stated in your offer to purchase/booking form, including but not limited to all matters necessary to effect the execution of a formal sale and purchase agreement and deed of mutual covenants between us in relation to your purchase of the said property (hereinafter respectively referred to as the “Sale & Purchase Agreement” and “Deed of Mutual Covenants”), to effect your ownership of the property in accordance with the terms of the Sale & Purchase Agreement as well as to facilitate all obligations under the Sale & Purchase Agreement and Deed of Mutual Covenants to be discharged/enforced.
• For statistical analysis
• For our record keeping, the maintenance, and update of purchasers’ records
• For delivery of notices, information on our latest projects, products and/or services, and event updates
• For compliance with any legal or regulatory requirements relating to our services and projects
• For vacant possession services, keys handover, property/estate management, customer care, and/or defect rectification works to assist you in applying for end-financing to finance the purchase property and any subsequent commercial transactions in relation to any of our projects, products, and/or services.

3. Disclosure

i. List of Persons/Organizations to Whom the Data May Be Disclosed:

• Our authorised representatives, agents, contractors, sub-contractors, engineers, surveyors, architects, banks/financial institutions, lawyers, legal advisors, utility companies, employees, and third-party service providers to enable them to provide administrative and other services for or to you/the property acquired by you, including but not limited to all matters in relation to your purchase of the said property, all matters necessary to effect your ownership of the property in accordance with the terms of the Sale & Purchase Agreement as well as to facilitate all obligations under the Sale & Purchase Agreement and Deed of Mutual Covenants to be discharged/enforced.
• Others where the disclosure is required by law, for example, to government agencies and regulatory bodies as part of our statutory obligations, or for law enforcement purposes.
• An organisation that acquires all or part of our assets or businesses.
• The relevant Joint Management Body established under the Building and Common Property (Maintenance and Management) Act 2007 and/or the management corporation established under the Strata Titles Act, 1985, and/or any other statutory provision.
• To our customer service agencies for research and analysis purposes so that we can monitor and improve the services we provide.
• Administrative purposes and statistical analysis service providers, agents, and/or contractors from time to time to help us with delivery of notices and to provide and market our products and services to you.
• Government agencies, statutory authorities, and industry regulators.
• Our auditors, consultants, accountants, or other financial or professional advisers.
• Any other persons which Herry Razak Realty may think fit notwithstanding that such persons may be outside Malaysia, for any purposes.

ii. We will retain your personal information for a reasonable period in accordance with legal requirements, for administration and/or accounting purposes, or to protect our interest if deemed necessary.

iii. We would like to share with you our latest marketing information updates via the following methods if mutually agreed:

• SMS
• Email
• Telephone
• Electronic Direct Mailing (EDM)
• By way of postage (Invitation Card)
• Blast (WhatsApp/SMS)
• Other forms of marketing tools/channel (including internet social media service)

iv. If you do not wish the disclosure of your information to a particular party/group and/or to receive any direct marketing information about us and/or third parties/and/or disagree to any particular channel for disembarking information to you as provided above, you may put your request in writing to us at the address or facsimile transmission number, and mark it for the attention of the person or officer of the addresses set out below, or at such other address or facsimile transmission number or person or officer as the addressee may give notice of you from time to time.

4. Security and Retention

The security of your personal data is our priority. Herry Razak Realty takes all physical, technical, and organisational measures needed to ensure the security and confidentiality of personal data. We store your personal data in hard and/or soft copy in our office either in Microsoft Office and/or IFCA Property Software.

5. Acceptance of The Policy

You are given notice that the Products and/or Services will only be made available to you upon your accepting and expressly consenting to the terms of this Privacy Policy, where such express acceptance and consent shall be evidenced by you clicking or checking or indicating accordingly on the relevant consent portion of the registration forms or such other documents as may be furnished to you, as the case may be. By so indicating your acceptance of the term of this Privacy Policy, you shall be deemed to have expressly consented to the processing of your personal data by Herry Razak Realty or any of its authorized agents, employees, partners, and/or contractors for purposes as outlined. You hereby agree and accept that by registering and/or continuing to use the Products and/or Services, you authorize and consent to your personal data being processed by and, where required, disclosed to classes of third parties as identified by Herry Razak Realty for the purposes of Herry Razak Realty providing the Products and/or Services to you. For the avoidance of doubt, you also hereby explicitly consent to Herry Razak Realty processing any sensitive personal data relevant for such purposes.

6. Withdrawal of Consent

Notwithstanding anything to the contrary, you may at any time withdraw your consent to Herry Razak Realty processing any personal data of yours or to any part or portion of the same by sending to Herry Razak Realty at the address set out below a written notice of withdrawal and within the period prescribed under the PDPA. Herry Razak Realty shall take all necessary measures to give effect to your withdrawal of consent, to the extent that such withdrawal does not conflict with any of Herry Razak Realty’s other legal obligations. If you do not wish to have your personal data shared with any other party, or if you do not wish to be solicited for products or services offered by Herry Razak Realty or any other parties, including third parties, kindly inform us in writing at the communication information given below. You shall, upon written request, be granted access to all personal data held or stored or processed by Herry Razak Realty. To avoid confusion, “access” for the purposes of this provision shall mean notification of such personal data of yours that is processed by or on behalf of Herry Razak Realty and to have a copy of such personal data communicated or conveyed to you in an intelligible form of Herry Razak Realty’s choosing.

7. Right to Access and Correct Personal Data

You may at any time make a written request to Herry Razak Realty to correct any personal data of yours that is inaccurate, incomplete, misleading, or out-of-date, and Herry Razak Realty shall, upon receipt of your written request for correction(s), take all necessary measures to give effect to such correction(s). Should you have any enquiries or complaints pertaining to your personal data, by publishing this policy on this website, we shall deem our customers and/or clients have already been notified. Herry Razak Realty reserves the right to update and amend this Policy from time to time without prior notice. Any material changes will be posted on our website with the updated Privacy Policy.
